1. Overview

Welcome to Dental Home. These Terms of Service (the “Terms”) govern your access to and use of www.dentalhome.top, our online store and all related information, content, features, tools, products and services (collectively, the “Services”).

The Services are managed by Dental Home (Dongguan) Medical Device Co., Ltd. Our international business and certain payment activities may also be supported by Dental Home (Hong Kong) Medical Devices Limited. The Services are powered by Shopify.

Depending on the order and payment method, the contracting seller may be:

  • Dental Home (Dongguan) Medical Device Co., Ltd.; or

  • Dental Home (Hong Kong) Medical Devices Limited.

The seller applicable to a specific order will be identified in the checkout information, payment record, accepted quotation, pro forma invoice, order confirmation, receipt or commercial invoice relating to that transaction. The identified seller is referred to in these Terms as “Dental Home,” “we,” “us” or “our.”

If you are uncertain which entity is the seller for an order, please contact us before making payment.

By accessing or using the Services, creating an account, submitting an order or purchasing a product, you agree to these Terms and the policies incorporated by reference. If you do not agree, you must not use the Services.

If we have entered into a separate written agreement, approved quotation, pro forma invoice, customization agreement or distribution agreement with you, that document will control to the extent of any direct conflict with these Terms.

Nothing in these Terms excludes or limits any right or remedy that cannot lawfully be excluded or limited.

2. Eligibility, Professional Use and Accounts

You must be at least 18 years old and have the legal capacity and authority necessary to use the Services and enter into a binding contract.

Our dental implant prosthetic components, instruments and related products are intended to be purchased, selected, handled and used by qualified dental professionals, licensed dental laboratories, authorized distributors or other persons permitted under applicable law.

By purchasing a professional dental product, you represent that:

  • You are appropriately qualified or are purchasing on behalf of an appropriately qualified organization;

  • You have authority to bind the person or organization named on the order;

  • The purchase, importation, resale, distribution, sterilization and use of the product are permitted in the destination country;

  • The product will be used only for its intended professional purpose and in accordance with applicable instructions, professional standards and laws.

You must provide accurate, current and complete account, billing, shipping and contact information.

You are responsible for protecting your account credentials and for activity conducted through your account. You may not transfer or sell your account to another person.

We may refuse, suspend or close an account where information is false or incomplete, the account is used without authorization, or its use creates a legal, safety, fraud or security risk.

3. Product Information

We make reasonable efforts to describe and display our products accurately. Images may be enlarged for detail, and colors, surface finishes, proportions, packaging and appearance may vary because of screen settings, production updates, photography or differences between product sizes.

The confirmed product code, implant system, connection, platform, diameter, gingival height, angle, screw specification, quantity and written order confirmation take priority over illustrative images.

We may correct product information, update specifications, discontinue products or limit quantities at any time. Changes will not affect an order already accepted unless the change is necessary for safety or legal compliance, or is agreed with you.

4. Compatibility and Product Selection

You are responsible for confirming the correct implant system, connection, platform, diameter, gingival height, angle, screw specification and product code before ordering or using a product.

Implant components and screws designed for different systems, platforms or brands may have different dimensions and must not be mixed unless compatibility has been expressly confirmed by us in writing.

Product names, similar appearance or apparent fit do not establish clinical or mechanical compatibility.

You must inspect all product identification and compatibility information before use. Do not use, install, modify or sterilize a product if its identity, condition or compatibility is uncertain.

Please contact us before ordering or using the product if you require compatibility confirmation.

Unless expressly stated otherwise, products described as compatible with, “for,” or suitable for a third-party implant system are independently manufactured compatible components and are not original products manufactured by that third-party brand.

References to third-party names, product codes, systems or trademarks are used solely to identify intended compatibility. They do not imply sponsorship, authorization, affiliation or endorsement by the relevant trademark owner.

5. Orders and Acceptance

Submitting an order constitutes an offer to purchase. An automated acknowledgement does not necessarily mean that we have accepted the order.

An order is accepted when we:

  • Expressly confirm acceptance;

  • Confirm that production or fulfilment has begun; or

  • Dispatch the products,

whichever occurs first.

We may refuse or cancel an order before acceptance because of:

  • Stock availability;

  • Pricing or description errors;

  • Payment failure;

  • Suspected fraud;

  • Legal or regulatory restrictions;

  • Shipping limitations;

  • Product safety or compatibility concerns.

Payment must be received and successfully processed before we are required to manufacture or dispatch products unless different payment terms have been agreed in writing.

Please check all order details before making payment. Requests to change or cancel an accepted order are subject to our approval and may not be possible after product allocation, manufacturing, customization or dispatch has begun.

6. Custom and Special Orders

Custom-made, specially manufactured, personalized or non-catalogue products are produced according to the specifications confirmed in the applicable quotation, technical drawing, physical sample approval, invoice or written communication.

For customization involving a non-catalogue implant system, we normally require both:

  • An approved technical drawing; and

  • A physical sample.

Both requirements must be satisfied before we evaluate or begin production unless we expressly agree otherwise in writing.

We will not rely solely on a photograph, verbal description or unverified comparison with another implant system.

You are responsible for carefully reviewing and approving all specifications before production.

Once production of a custom or special order has begun, the order cannot normally be changed, cancelled, returned or refunded, except where the product is defective, does not conform to the agreed specifications or applicable law requires otherwise.

Any stated customization or production lead time is an estimate unless we expressly guarantee a completion date in writing.

7. Prices, Payments and Billing

Prices, discounts and promotions may change without notice. The price applicable to an accepted order is the price shown in the order confirmation, approved quotation, pro forma invoice or other written confirmation.

Unless expressly stated otherwise, prices exclude:

  • Shipping charges;

  • Optional insurance;

  • Customs duties;

  • Import taxes;

  • Value-added taxes;

  • Brokerage and clearance fees;

  • Bank charges;

  • Payment-provider charges;

  • Other government or third-party charges.

Depending on the selected payment method and order arrangement, payment may be received by Dental Home (Dongguan) Medical Device Co., Ltd. or Dental Home (Hong Kong) Medical Devices Limited.

The payment recipient shown in the checkout, payment request, PayPal transaction, bank instructions, invoice or receipt must correspond to an authorized Dental Home entity.

Do not send payment to a personal or unrelated third-party account unless the arrangement has been expressly confirmed through our official contact information.

You represent that you are authorized to use the selected payment method and that all payment and billing information you provide is accurate.

Payments may be processed by Shopify, PayPal, banks or other third-party payment providers under their own terms and privacy policies.

If a pricing or calculation error is identified before dispatch, we may contact you to confirm the order at the correct price or cancel and refund the affected order.

8. Shipping, Delivery, Customs and Risk

All orders placed through our online store are processed and dispatched from Dongguan, Guangdong Province, Mainland China.

Shipping methods, estimated delivery times and charges will be shown at checkout, stated in the applicable order documents or agreed separately in writing.

Delivery dates and transit times are estimates unless we expressly provide a written guarantee.

We are not responsible for delays caused by carriers, customs authorities, inspections, import licensing, inaccurate customer information, force majeure events or other circumstances outside our reasonable control. We will provide reasonable assistance with carrier enquiries or customs documentation where appropriate.

International orders are normally shipped on a DAP (Delivered at Place) basis unless a different shipping term is expressly agreed in writing.

For business customers, title and risk of loss pass in accordance with the Incoterm or shipping term agreed in writing. If no shipping term is agreed, risk passes when the products are handed to the first carrier, to the extent permitted by applicable law.

For customers who qualify as consumers under mandatory applicable law, risk passes at the time required by that law.

For European Union consumers, risk will normally pass when the consumer or a person designated by the consumer, other than the carrier, takes physical possession of the products, unless the consumer independently selected a carrier that was not offered by us.

You are responsible for providing a complete and accurate shipping address and cooperating with delivery and customs requirements.

Additional expenses caused by an incorrect address, refusal of delivery, failure to collect a shipment or failure to provide required import information may be charged to you where permitted by law.

Dental Home currently does not collect destination-country customs duties, import taxes, value-added taxes, brokerage fees or customs-clearance charges at checkout.

The customer or designated importer is responsible for destination-country import permits, registrations, taxes, duties, brokerage fees and compliance requirements, except where we expressly agree otherwise or applicable law places the obligation on us.

All invoices, customs declarations and shipping documents must be accurate and lawful. We may refuse any request to make a false statement, use an inaccurate product description or knowingly misdeclare the nature, quantity or value of goods.

9. Returns and Refunds

Returns, exchanges, cancellations and refunds are governed by our Return and Refund Policy, which forms part of these Terms.

Custom products, opened sealed products that cannot safely be returned for genuine health or hygiene reasons, and products that have been used, installed, sterilized, altered, contaminated or placed in a patient’s mouth may not qualify for return, subject to applicable law and our Return and Refund Policy.

Nothing in these Terms or our Return and Refund Policy limits mandatory rights relating to defective, damaged, incorrectly supplied or non-conforming goods.

10. Inspection, Defects and Product Issues

Please inspect the shipment, packaging, product codes, labels, quantities and visible condition promptly after delivery.

If products are damaged, defective, incorrect or incomplete, contact us as soon as reasonably possible:

Providing notice within seven days after delivery helps us investigate shipping damage and packing errors, but this requested reporting period does not limit any mandatory legal rights.

Please keep the product, original packaging, shipping label, product label and lot or batch information. We may request photographs, videos, measurements or return of the affected product for evaluation.

Do not use, install, sterilize, modify or place a product in a patient’s mouth if it may be defective, damaged, incorrectly supplied or incompatible.

Depending on the circumstances and applicable law, an available remedy may include replacement, resupply, price reduction, store credit, partial refund or full refund.

Product issues caused by incorrect selection, cross-system mixing, unauthorized modification, improper handling, storage, sterilization, installation, use outside the intended purpose, normal wear or failure to follow applicable instructions are not manufacturing defects.

Where consumer protection law provides a statutory guarantee or another mandatory remedy, those rights remain unaffected.

11. Professional Responsibility and Regulatory Compliance

Website content, compatibility information, catalogues, drawings and customer support are provided for product identification and general information.

They are not patient-specific medical or clinical advice and do not replace the professional judgment of a qualified practitioner.

The treating professional is solely responsible for:

  • Patient assessment;

  • Treatment planning;

  • Clinical product selection;

  • Cleaning, disinfection and sterilization;

  • Installation and use;

  • Informed consent;

  • Ongoing patient care.

Customers, importers, distributors, laboratories and professional users are responsible for complying with the laws, professional requirements, product registrations, licensing conditions, traceability obligations, reporting duties and safety requirements applicable to their activities and jurisdictions.

You must not remove, alter or obscure product labels, lot information, safety information or traceability records where those records are required for lawful distribution or use.

12. Intellectual Property

The Services and their original content, including our text, product photographs, graphics, videos, catalogues, page designs, databases, logos and other materials, are owned by or licensed to Dental Home and are protected by applicable intellectual property laws.

You may use the Services only for lawful purchasing, product evaluation and business communication.

Unless we provide prior written permission, you must not reproduce, modify, republish, distribute, scrape, commercially exploit or create derivative works from our content.

No license or ownership right is granted except for the limited right to use the Services in accordance with these Terms.

13. Prohibited Uses

You must not use the Services:

  • For an unlawful, fraudulent, deceptive or malicious purpose;

  • To violate applicable laws, regulations, sanctions, export controls or third-party rights;

  • To submit false purchasing, payment, customs, identity or compatibility information;

  • To infringe intellectual property, privacy, confidentiality or other rights;

  • To upload viruses, malicious code or harmful material;

  • To interfere with the security, operation or availability of the Services;

  • To scrape, crawl, harvest or collect data without authorization;

  • To send spam, phishing messages or unauthorized promotions;

  • To impersonate another person or misrepresent your authority;

  • To purchase, distribute or use a regulated product in a manner prohibited by law.

We may suspend access, reject an order or close an account where we reasonably believe these restrictions have been violated.

14. Optional Tools and Third-Party Links

The Services may provide access to third-party tools, applications, payment services, social-media features or external websites.

We do not control those third parties and are not responsible for their content, availability, security, products or practices.

Your use of third-party services is governed by the relevant third party’s terms and privacy policy. Please review those terms before using the service or completing a transaction.

15. Relationship With Shopify

Dental Home is powered by Shopify, which enables us to provide the Services.

However, sales and purchases made through our store are transactions directly between you and the Dental Home entity identified as the seller for the applicable order.

Shopify is not the seller of Dental Home products and is not responsible for product selection, compatibility, manufacturing, delivery, use, returns or refunds.

To the extent permitted by applicable law, you release Shopify and its affiliates from claims arising directly from your purchase or transaction with Dental Home.

16. Privacy

Our collection and use of personal information are governed by our Privacy Policy, which forms part of these Terms.

Because the Services are hosted by Shopify, Shopify also processes certain information relating to your access to and use of Shopify-powered stores. Please review the Shopify Consumer Privacy Policy for more information.

Do not submit patient names, identification numbers, medical histories, identifiable clinical photographs or other sensitive patient information through reviews, order notes, ordinary email, WhatsApp or website forms.

17. Reviews and Feedback

If you voluntarily submit a review, suggestion, photograph, video, idea or other feedback (“Feedback”), you grant us a non-exclusive, worldwide and royalty-free license to use, reproduce, adapt, publish, translate and display that Feedback for operating, improving and promoting our business and Services.

You represent that:

  • You own or have permission to submit the Feedback;

  • The Feedback is accurate;

  • Any incentive has been disclosed;

  • The Feedback does not violate intellectual property, privacy, confidentiality, professional or other rights.

Do not include patient information or content that identifies a patient.

We may remove Feedback that is unlawful, misleading, offensive, infringing, unsafe or inconsistent with these Terms.

18. Errors and Availability

The Services may occasionally contain typographical errors, inaccuracies, omissions, interruptions or outdated information concerning product descriptions, prices, promotions, shipping charges, transit times or availability.

We may correct errors and update information.

If an error materially affects an order that has already been submitted, we will contact you and provide an appropriate option, which may include confirming the corrected order or cancelling and refunding it.

We do not guarantee that the website or every feature will always be uninterrupted, secure or error-free.

19. Disclaimers

Website information is provided for general product and commercial information. It is not medical, clinical, legal, tax, customs or regulatory advice.

Except for warranties expressly stated in an accepted order, product document or mandatory applicable law, the Services are provided on an “as available” basis.

We do not make warranties regarding uninterrupted website access, third-party services or results obtained from relying on general website information.

Product purchases remain subject to the express product commitments in the accepted order, our Return and Refund Policy, and all warranties, guarantees and remedies that cannot lawfully be excluded.

20. Limitation of Liability

Nothing in these Terms excludes or limits liability for:

  • Fraud or fraudulent misrepresentation;

  • Willful misconduct;

  • Gross negligence where it cannot lawfully be limited;

  • Death or personal injury caused by negligence;

  • Defective-product liability that cannot lawfully be excluded;

  • Mandatory consumer rights;

  • Any other liability that applicable law does not permit us to exclude or limit.

To the fullest extent permitted by law, neither Dental Home nor its directors, officers, employees, affiliates, agents, contractors or service providers will be liable for indirect, incidental, special, punitive or consequential losses, including loss of profit, revenue, business opportunity, goodwill, anticipated savings or data, arising from use of the Services or an order.

For business customers only, and to the fullest extent permitted by law, our total aggregate liability arising from an affected order will not exceed the amount actually paid to the applicable Dental Home seller for the product giving rise to the claim.

This limitation does not apply to liabilities that cannot legally be excluded or limited.

21. Business Customer Indemnity

If you use the Services or purchase products in the course of a business, you agree, to the extent permitted by law, to indemnify the applicable Dental Home seller and its affiliates, directors, officers, employees, agents and service providers against third-party claims, losses and reasonable costs arising from:

  • Your material breach of these Terms;

  • Your unlawful importation, resale, distribution, modification, labelling, promotion or use of a product;

  • Your infringement of a third party’s intellectual property, privacy or other rights;

  • Your use of a product outside its intended purpose;

  • Your mixing of incompatible components or systems;

  • Your use contrary to confirmed compatibility information.

This section does not require you to indemnify us for losses caused by our own negligence, unlawful conduct or breach of contract.

22. Suspension and Termination

We may suspend or terminate access to the Services where reasonably necessary to address:

  • A breach of these Terms;

  • Non-payment;

  • Suspected fraud;

  • Security risks;

  • Unlawful conduct;

  • Risks to customers or third parties.

Termination does not affect rights and obligations accrued before termination.

Provisions that by their nature should continue—including payment obligations, intellectual property rights, liability limitations, governing law and dispute provisions—will survive termination.

23. Severability

If any provision of these Terms is held to be unlawful, invalid or unenforceable, it will be enforced to the greatest extent permitted, and the remaining provisions will continue in effect.

24. Waiver and Entire Agreement

Failure to enforce a provision is not a waiver of that provision or any other right.

These Terms, together with the policies and accepted order documents incorporated by reference, form the agreement between you and the applicable Dental Home seller concerning the Services.

They supersede prior communications concerning the same subject, except in cases involving fraud or fraudulent misrepresentation.

25. Assignment

You may not transfer an accepted order, account or rights under these Terms without our prior written consent.

We may transfer our rights and obligations as part of a merger, restructuring, sale of business or transfer to an affiliate, provided that the transfer does not reduce any mandatory consumer rights.

26. Governing Law and Disputes

Before starting formal proceedings, both parties should attempt in good faith to resolve the dispute by providing the relevant order, payment and claim information through our official contact details.

Orders Sold by the Hong Kong Company

Where the seller identified for an order is Dental Home (Hong Kong) Medical Devices Limited, these Terms and the applicable transaction are governed by the laws of the Hong Kong Special Administrative Region, without regard to conflict-of-laws principles.

For business customers, the courts of Hong Kong will have exclusive jurisdiction unless a separate written agreement provides otherwise.

Orders Sold by the Dongguan Company

Where the seller identified for an order is Dental Home (Dongguan) Medical Device Co., Ltd., these Terms and the applicable transaction are governed by the laws of the People’s Republic of China.

For business customers, the competent courts in Dongguan, Guangdong Province will have exclusive jurisdiction unless a separate written agreement provides otherwise.

Consumer Rights

If you qualify as a consumer, these governing-law and jurisdiction provisions do not deprive you of any mandatory consumer protection or right to bring a claim in another competent court that cannot lawfully be excluded.

27. Changes to These Terms

We may update these Terms to reflect changes in our Services, business practices, technology or legal obligations.

The current version will be posted on this page with a revised “Last updated” date.

Material changes will apply prospectively from the effective date stated in the notice, except where immediate application is required by law or for urgent safety or security reasons.

Changes will not retroactively alter an accepted order unless agreed by the parties or required by law.
